These terms cover your use of Octocise. By using the service you agree to them. Octocise is operated from Sydney, Australia.
The service
Octocise is a done-for-you revenue layer with three modules — Capture, Grow and Revive. It works behind the scenes, in your voice, and reaches you as approvals. You choose what sends; nothing customer-facing goes out without the controls you set.
Plans & billing
- Pricing is $149/month for one module, $249 for two and $299 for the full platform. Annual plans are billed at twelve months for the price of ten.
- There is no setup fee and no minimum term — you can cancel any time, effective at the end of your current billing period.
- Message allowances and overage rates are shown on the pricing page. A 14-day free trial is available with a card on file.
Your responsibilities
- Use Octocise lawfully and only to contact people your business has a legitimate basis to contact.
- Comply with applicable marketing and spam laws (including the Spam Act 2003 (Cth)) — you control and approve what is sent.
- Keep your account credentials secure.
Your data responsibilities
For your customers' personal information, you are the data controller and Octocise is your processor — we handle that information on your instructions to provide the service. You warrant that, for every person you contact through Octocise or whose details you upload or capture (for example through a booking link or enquiry form), you have a lawful basis and any consent the law requires, including under the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth), and that you have given those people any privacy notice they are owed. Octocise provides sender identification and a working unsubscribe on messages sent on your behalf; obtaining and holding consent remains your responsibility. You agree to indemnify Octocise against claims arising from your breach of these responsibilities. If we become aware of a data breach affecting your customers' information, we will notify you without undue delay so you can meet your obligations under the Notifiable Data Breaches scheme.
Availability
We work hard to keep Octocise fast and available, but the service is provided "as is" without warranties of uninterrupted operation. We are not liable for indirect or consequential loss to the extent permitted by law; nothing in these terms excludes rights you have under the Australian Consumer Law.
Changes
We may update these terms or the service. If a change is material, we'll let you know. Continued use after a change means you accept the updated terms.
